CA Gov. Brown Signs SB 1172 Protecting California’s Youth

FOR IMMEDIATE RELEASE: September 30, 2012

Gov. Brown Signs SB 1172 Protecting California’s Youth

Law will ban harmful psychological abuse of children

WASHINGTON – California Gov. Jerry Brown has signed into law SB 1172, a bill that will put an end to dangerous and disproved efforts designed to change a young person’s sexual orientation or gender expression that have proven to inflict great emotional harm.  Upon learning of the governor’s signing of the bill, Human Rights Campaign President Chad Griffin issued the following statement:

"We're grateful to Governor Brown for standing with California's children. LGBT youth will now be protected from a practice that has not only been debunked as junk science, but has been proven to have drastically negative effects on their well-being. We commend Governor Brown for putting children first, and call on all states to take California’s lead on this issue.  We will continue our fight against this kind of child abuse, which has been deemed harmful to children by all major mental health, medical, and child welfare organizations."

Authored by California Senator Ted Lieu, SB 1172 was sponsored by Equality California, the National Center for Lesbian Rights, Gaylesta, Lambda Legal, Mental Health of North America, and the Courage Campaign.  This week nearly 50,000 concerned citizens signed a Human Rights Campaign petition urging the Governor to sign the bill.

Efforts to change sexual orientation or gender expression have been debunked as junk science, and have also been proven harmful to children and adults.  All major medical and mental health organizations have denounced the practice including: the American Psychological Association, the American Psychiatric Association, the American School Counselor Association, the American Academy of Pediatrics, the American Medical Association, the National Association of Social Workers, the American Psychoanalytic Association, the American Academy of Child and Adolescent Psychiatry, and the Pan American Health Organization.  Learn more at www.hrc.org/reparativetherapy

Time: How Columbus, Ohio Bounced Back from the Recession

If you ever wonder what kind of economic development might be accomplished in this country with more bipartisan cooperation, consider Columbus, Ohio. It’s become a celebrity city of sorts lately, talked up in a New York Times Magazine piece about the success of Ohio, and visited over a dozen times by the presidential candidates on the campaign trail. No wonder – the Columbus metropolitan area has created more jobs than any other place in Ohio over the last two years and it’s become a model for what an economy can do when you admit that growth isn’t about tax cuts and austerity but about both streamlining government and investing in the right things.

The quick story of Columbus is that a Democratic mayor got a bunch of Republican businessmen in the city to agree to – gasp – a tax increase, in order to do the kinds of investments (in infrastructure, job retraining, education, and downtown renovation) that result in real growth. And that’s what they’ve gotten there. There’s plenty in Columbus that comes straight out of the Brookings/McKinsey playbook – German style industrial research centers, a strong community and state college system and smart ways of tapping Chinese investment. I could go on—but instead, you should go read my latest Curious Capitalist column in Time magazine, which tells the full story.

(MORE: How Bad is America’s Pension Funding Problem?)

Columbus is representative of a bigger shift in this country. I think that post election, the economics and job creation focus is going to move to cities and what’s happening at the local level in places like Columbus, Chicago, Portland, Raleigh, Minneapolis, Mesa, and San Jose. We’ll move from a simplistic conversation about tax cuts versus spending, and we’ll start admitting that we really have no idea why US GDP growth is as slow as it is, and there’s no one way to explain the 2 percent economy (which is really a 5 percent or 0.5 percent economy depending on where you live). And, we’ll have to start experimenting with lots of different paradigms. That will happen at the city level.

I think what we may see is a kind of industrial policy executed via cities; they become the petri dishes in which we do different growth experiments. Each one will tell a story – how to boost exports, create creative industry hubs, revamp housing, retrain Rust Belt workers, etc. There will be important political and cultural implications in all this, too (next week, I am planning to do some reporting in San Bernardino on that city’s attempt to use eminent domain to force banks to restructure underwater loans). As I said in my “Go Glocal” feature recently in Time magazine, all economics is local. Expect the economic and business news next year to be just that.

Columbus Dispatch: Grand jury does not indict Victorian Village man who fatally shot partner

By  John Futty
The Columbus Dispatch Wednesday September 26, 2012 2:37 PM

A Victorian Village man who said he was acting in self-defense when he fatally shot his partner five months ago has been cleared by a Franklin County grand jury.

John A. Reed, 54, was arrested on April 6 after he called 911 to report that he had just shot his roommate, Jeffrey A. Caldwell, at 69 W. 5th Ave.

“He was killing me, he was trying to kill me,” Reed told the operator.

Although Franklin County Common Pleas Court records show that the case remains active, a grand jury heard the evidence in late July and decided not to indict Reed, Prosecutor Ron O’Brien said.

Defense attorney Terry K. Sherman said he took the unusual step of giving his evidence and witnesses to the prosecutor’s office for use in their grand-jury presentation. Reed testified before the grand jury.

“It’s unusual but not unheard of” for a defendant to testify in a grand-jury hearing, Sherman said.

O’Brien said the targets of grand-jury proceedings testify “on occasion” at the request of a defense attorney or after an invitation from prosecutors. He called the practice “fairly rare.”

Reed had been the victim of ongoing domestic abuse in his relationship with Caldwell, 56, Sherman said.

“It was battered woman’s syndrome, but involving a guy,” he said.

Reed told police that he and Caldwell were in an argument that turned violent on the night of the shooting. He said Caldwell was beating him and he feared for his life.

Reed “grabbed his .22-caliber revolver and as (Caldwell) cornered him in the bathtub, he shot (Caldwell),” according to a report read during Reed’s initial appearance in court on April 9. He was released on bond after the hearing.

Reed retired in 2008 after about 30 years as an employee at the Ohio State University Medical Center.

Caldwell worked at the Kroger store in the University District and formerly operated Caldwell Interiors Ltd.

Sherman called the case “about as good as you can get for self-defense.”

Columbus Dispatch: Italian Village store closed pending drug-sales investigation

By  John Futty
The Columbus Dispatch Thursday September 27, 2012 8:03 PM

An Italian Village convenience store accused of selling bath salts and synthetic marijuana will remain padlocked while a Franklin County judge determines whether it should be closed permanently.

The S&K Market, 127 E. 5th Ave., has been closed since Sept. 17, when the Franklin County prosecutor’s office filed a civil action saying the property is a public nuisance because its owners and operators knowingly allowed felony drug sales.

Environmental Judge Harland H. Hale granted a temporary restraining order that prohibits the store from operating until the case is decided.

The case was set for trial today, but the judge granted a continuance while attorneys attempt to resolve criminal cases against two brothers who co-own the business.

The market, along with two Short North businesses, was raided on July 25 by the Franklin County Drug Task Force as part of a nationwide crackdown on synthetic designer drugs.

Soleiman Mobarak, 29, of Solera Drive on the North Side, and Hasan Mobarak, 28, of Rita Joanne Lane on the Northeast Side, are charged with aggravated trafficking in drugs and trafficking in spice, which refers to a mixture marketed as synthetic marijuana.

Undercover officers purchased bath salts — synthetic hallucinogens that have been linked to psychotic episodes and deaths — and synthetic marijuana during visits to the store, according to the complaint filed by prosecutors.

The suit asks the judge to eliminate the nuisance by ordering the sheriff’s office to “close and padlock” the building and “take possession of furniture, fixtures, equipment and material.”
A new trial date has not been set.

Columbus Dispatch: Goodale Park fountain spouts water again

By  Mark Ferenchik
The Columbus Dispatch Friday September 28, 2012 12:12 PM

It’s been two weeks since the Goodale Park fountain was turned on.

The water continues to spout. The pond in which it sits is holding water.

All is well. (For now, anyway.)

“Everybody’s pretty happy about it,” said Jason Kentner, the president of the Friends of Goodale Park.

Not to mention relieved.

The water to the fountain was turned on back on Sept. 14. That was a little more than two months after the pond was refilled.

Kentner’s group spent $8,500 to install a rubberized lining around the base of the fountain in June to fix a leak that had drained the pond since last fall.

That came after the city spent $144,600 to line the bottom of the pond in April with a clay called bentonite to plug the leak. That fix didn’t work.

Kentner said the city also installed a new ground water pump to recharge the pond during dry weather.

HRC - Chick-fil-A Fails to Live Up to Promises of Stricter Donation Guidelines

FOR IMMEDIATE RELEASE: September 20, 2012

Chick-fil-A Fails to Live Up to Promises of Stricter Donation Guidelines

Fast food chain is still actively raising money for the anti-LGBT Marriage and Family Foundation

Washington – The Human Rights Campaign – the nation’s largest lesbian, gay, bisexual and transgender (LGBT) civil rights organization – is condemning Chick-fil-A for continuing to actively raise money for anti-LGBT organizations like the Marriage and Family Foundation. The Advocate is reporting that Chick-fil-A President Dan Cathy tweeted a photo from an event raising funds for the anti-LGBT group on Tuesday – the very same day that news broke of the fast food chain’s apparent decision to no longer financially support groups that promote discrimination.

“Chick-fil-A can’t claim to be turning over a new leaf while simultaneously funneling thousands of dollars towards a group that does not acknowledge the dignity and respect of LGBT people,” said HRC Vice President of Communications Fred Sainz. “Chick-fil-A and the WinShape Foundation are at a turning point and face a fundamental question: will they continue actively using customer dollars to support groups that demonize LGBT people, or will they once and for all act like a responsible business and stop supporting discrimination?

“This issue is not – nor has it ever been about – whether a particular organization supports marriage equality. It is about the fact that Dan Cathy’s personal views are leading to corporate dollars being used to prop up groups that demonize and spread malicious falsehoods about LGBT people. Americans can agree upon the values that make our country great – fairness, respect, and dignity for all. There are a number of organizations that work to promote these types of values. Unfortunately, Chick-fil-A is continuing to support organizations that do not reflect mainstream American values.”

In addition to being out-of-step with most Americans, Chick-fil-A’s current anti-LGBT donations are simply bad for business – and this summer’s earlier controversy adversely impacted their brand. According to According to YouGov’s BrandIndex, Chick-fil-A’s perception with consumers dropped from a 65– nearly 20 points above the national average for other fast food chains – to a 39 in the week after Dan Cathy’s proud and very public embrace of his company’s anti-LGBT practices. Central Ohio ends summer with rising home sales and prices

Central Ohio ends summer with rising sales and prices

(Sept. 19, 2012) Home sales during the most active time of the year showed impressive gains over last year and were the highest since 2007 when the housing market began its descent after the boom.

The 8,921 residential home closings during the months of May through August were 11 percent higher than last
summer and 12.2 percent higher than in 2009 when home sales hit its lowest point since the summer of 2000, according to the Columbus Board of REALTORS®.

“Higher prices, low rates and lower inventory proved to be an exceptional environment for home sellers this summer,”
said Jim Coridan, 2012 President of the Columbus Board of REALTORS®. “But the strongest factor was and continues to be the abundance of motivated buyers in the market today.”

Demand outstripped supply, as new listings on the market (3,096) fell 0.9 percent from the month before and the total inventory of homes for sale (11,571) was down 32.3 percent from the same time last summer (17,096).

“We’ve seen higher sales gains and falling inventory for over a year now which has pushed home prices up,” Coridan said. “We’re hoping more homeowners with an interest in selling recognize their advantage this fall as it’s getting tough to find property to sell.”

Not only that, the average turn-around time from the date “For Sale” signs went up until a bargain was struck
decreased 15.5 percent last month from 96 days to 81 days.

HRC Releases Competency Guide for Emergency Responders

FOR IMMEDIATE RELEASE: September 18, 2012
Paul Guequierre

HRC Releases Competency Guide for Emergency Responders

LGBT people, families in disaster situations often face higher risk of trauma

WASHINGTON – Today the Human Rights Campaign, the nation’s largest lesbian, gay, bisexual and transgender (LGBT) civil rights organization, released a guide for local, state, federal and community organizations, as to how best work with LGBT people and families during disasters or forced evacuations.  In an emergency or disaster situation, vulnerable populations like LGBT people are at a heightened risk for trauma and may be less likely to have access to emergency services.

“Many LGBT individuals and families fear discrimination in shelters or when seeking other emergency services during natural disasters or other forced evacuations,” said HRC President Chad Griffin.  “Emergency responders and volunteers need to be aware of the needs many in our community have, and should be sympathetic to the fact that families come in all shapes and sizes.  Our families deserve to be treated with respect and should never be separated due to a lack of legal recognition.”

HRC Legislative Counsel Robin Maril added, “LGBT families seeking assistance may experience unnecessary, intrusive questions from shelter volunteers and workers. After a disaster or evacuation, many people enter a shelter with very little personal identification or documentation.  For LGBT families, who often rely on a number of documents to prove their relationships to each other, or their children, this increases their vulnerability to discrimination.”

Housing and access to proper medical care can be especially challenging for transgender people after a disaster.  “Transgender people are often denied access to gender appropriate restroom and housing facilities, continued Griffin.  “This denial is not only humiliating, but can also be dangerous.”

For years HRC has advocated for protections for LGBT people and their families in accessing disaster relief services.  For example, as part of the Blueprint for Positive Change – a list of LGBT-specific non-legislative policy recommendations made to then President-elect Obama during his transition to the White House – HRC urged the Federal Emergency Management Agency (FEMA) to take steps to ensure that same-sex couples and their families are eligible for, and do not face discrimination in obtaining, federal disaster assistance.  HRC continues to urge FEMA and other federal agencies involved in disaster relief to make their programs as welcoming and inclusive of LGBT people as possible.

The competency guide comes in the middle of an already-busy Atlantic hurricane season, with thirteen named storms to date and experts predicting a busy second half.   In the Western United States, record-setting wild fires are displacing thousands of residents from their homes.

HRC Foundation Expands the Net of LGBT Healthcare Equality

FOR IMMEDIATE RELEASE: September 12, 2012
Paul Guequierre

Human Rights Campaign Foundation Expands the Net of LGBT Healthcare Equality

New program to focus on healthcare of LGBT seniors

WASHINGTON – With the goal of securing quality healthcare free of prejudice and discrimination for all Americans, the Human Rights Campaign Foundation, the educational arm of the nation’s largest lesbian, gay, bisexual, and transgender (LGBT) civil rights organization, today announced the formation of an innovative, wide-ranging Health and Aging Program. The new program will address both the health concerns of all LGBT Americans and the particular challenges faced by LGBT elders, including discrimination, mistreatment and isolation.  According to a study by MetLife, nearly one-third of gays and lesbians say discrimination based on sexual orientation is their greatest concern about aging.

“LGBT elders deserve unbiased, equitable, and welcoming healthcare and services,” said HRC President Chad Griffin.   “HRC’s Health and Aging program will help ensure they receive that care while expanding our already highly effective work in the health arena.”

To head the Health and Aging program, HRC hired Shane Snowdon, a seasoned advocate and nationally recognized expert on LGBT health and wellness. Snowdon comes to HRC from the University of California San Francisco, where she founded the acclaimed Center for LGBT Health & Equity in 1999.  Snowdon, who has served on the HRC Foundation Healthcare Equality Index (HEI) national advisory council, has provided training on LGBT healthcare to thousands of healthcare providers, developed criteria for culturally competent and welcoming LGBT care, and advocated for LGBT equality in a wide variety of settings.

“As a member of the first ‘out’ generation, I’m very excited about the work ahead,” said Snowdon. “LGBT people face real challenges around health and aging, and I look forward to making a real difference in their lives through my work in this new program.”

The Health and Aging program will include HRC’s signature health initiative, the Healthcare Equality Index, which showcases U.S. healthcare facilities that have demonstrated a commitment to LGBT equity and inclusion. The HEI, which has focused primarily on hospitals, will be expanded to survey and report on nursing and long-term care facilities serving elders.

The Health and Aging Program will also address other critical needs, including much-expanded LGBT training for healthcare and social services providers. The program will additionally provide a wealth of resources for LGBT people of all ages, designed to maximize their wellbeing and minimize the inequities they encounter.

New Report Outlines Wide-Sweeping Inequalities Faced by LGBT Americans

As general election looms, publication details the need for critical federal protections

WASHINGTON, D.C., SEPTEMBER 12, 2012 — With the presidential election a mere two months away, the stakes are high for the estimated nine million lesbian, gay, bisexual and transgender (LGBT) Americans whose daily lives are limited by a lack of federal protections. According to a new publication released today, most LGBT Americans live in a two-tier system where they must navigate conflicting state laws with the federal government’s refusal to offer the most basic securities, such as employment non-discrimination and anti-bullying protections.

An Ally’s Guide to Issues Facing LGBT Americans is a primer introducing the major areas in which unfair laws and stigma create extra burdens for LGBT Americans. The resource was developed by the Human Rights Campaign (HRC), Log Cabin Republicans, the Movement Advancement Project (MAP), Stonewall Democrats and the Victory Fund.

“LGBT Americans want and deserve the same chance as everyone else to pursue health and happiness, earn a living, be safe in their communities, and take care of their loved ones,” said HRC President Chad Griffin. “Unfortunately, unfair laws, lack of legal protections, and outdated prejudices stand in the way of these bedrock American values. We must work to change the hearts and minds of our fellow Americans, guiding them to fairness and equality.”

The past three years have brought historic gains: openly gay and lesbian servicemembers now are able to serve their country; LGBT people are included in the federal hate crimes law; and more states are passing or expanding laws which aim to protect LGBT individuals from bullying in schools and discrimination in housing and employment. However, as detailed in An Ally’s Guide to Issues Facing LGBT Americans details, LGBT Americans are simply still not equal under federal law.

Many LGBT people experience discrimination when just going about their daily activities–whether eating at a restaurant with their families or friends, trying to obtain safe, clean housing or applying for a loan. Contrary to popular belief, federal legislation does not protect LGBT people from discrimination in housing, public accommodations, credit or employment. LGBT people also lack such protections in most states. LGBT workers often cannot extend their health insurance coverage to their partners or children. Without family and marriage tax deductions, LGBT families pay additional taxes but have access to fewer benefits like Social Security Survivor Benefits. Due to these and myriad other inequalities, LGBT people are more likely to live in poverty and suffer from health disparities.

“With all of the media and political attention on marriage, very few Americans understand the full extent of the inequality LGBT Americans face every day,” said Jerame Davis, Executive Director of National Stonewall Democrats. “Kids in foster care are denied loving and qualified parents for no other reason than because those parents are gay or lesbian. Older LGBT Americans live in poverty because they’re denied access to Social Security Survivor Benefits. This resource highlights all of these issues and more in an accessible and easy to read manner.”

“LGBT or straight, Republicans are united in the belief that strong families are critical to a free society, and that equal opportunity is essential to the American dream. This report will be a valuable tool to persuade Americans of all political stripes of the need for equal protection for all families, including gay and lesbian service members and veterans, said Log Cabin Republicans Executive Director, R. Clarke Cooper.

“LGBT Americans want to serve their country as civic leaders, elected officials, members of the military and volunteers.  We're doing so in greater numbers than ever before, but there is still a glass ceiling of prejudice that keeps us from reaching our full potential," said Denis Dison, vice president of communications for the Gay & Lesbian Victory Fund and Institute. “The U.S. has never had an openly LGBT member of the president's Cabinet, nor an out U.S. Senator. There are no openly gay governors, and more than a dozen states still have no openly LGBT state legislators.  We're working to level the playing field for LGBT Americans who want to serve their communities.”

TIME - Guess the 2nd Most Sexually Satisfied City In the U.S.

Official: The Most Sexually Satisfied City In the U.S. Is…

Los Angeles? No? New York City? No? Milwaukee? Nope.

According to a Men’s Health survey, Indianapolis, Ind., is the most sexually satisfied city in the country.

The men’s magazine factored in condom sales, birth rates and sales of sex toys in their decision to declare Indianapolis No. 1 on its best sex list – for the second time. (The city also held the top ranking in 2008.) “Every year, the field of drivers in the Indianapolis 500 burns through a ton of rubber, but then so do the locals — Indy’s condom sales are 16th highest in the country, according to A.C. Nielsen data,” the magazine wrote. In fact, the Midwesterners proved themselves a kinky bunch indeed, claiming six of the top 10 slots in all.

Top Ten Most Sexually Satisfied Cities

1. Indianapolis, Ind.
2. Columbus, Ohio
3. Fort Wayne, Ind.
4. Cincinnati, Ohio
5. Salt Lake City, Utah
6. San Antonio, Texas
